Terms of Use

Last updated:

These terms govern your use of the BeThere participant app and website. By creating an account or booking a live presence session you agree to them. If you do not agree, do not use the service.

The service

BeThere offers live presence sessions. In each session a real person, the field operator, is physically at a place; a certified guide talks with you; and a director approves what is carried out. You send requests, and the director decides which are carried out and when. A session is live and unscripted: it is not a recording, and we cannot promise what you will see, hear or be able to do.

The field operator and the guide may decline or stop any request for safety, legal, venue or privacy reasons. The director may pause or end a session at any time, for example with a safety hold.

Your account

  • You must be 18 or older and able to enter a binding contract.
  • Give accurate information and keep your sign-in details secret. You are responsible for activity on your account. Tell us at once at hello@bthere.net if you suspect misuse.
  • One person, one account. You may not sell, share or transfer an account.

Bookings, prices and payment

  • The price, currency, date and number of seats are shown before you pay. The price is set by our servers; the app only displays it.
  • You pay on a Stripe-hosted checkout page. A booking is confirmed only when payment is confirmed by Stripe. A seat that is not paid for within the time allowed is released automatically.
  • You may add guest seats where offered. If you give a guest's phone number you must have their permission to do so.
  • Taxes, if any, are shown at checkout.

Cancellations and refunds

  • Your booking shows whether you can cancel it and what refund, if any, applies. The refund recorded on your booking is the refund that applies.
  • If we cancel a session, you are refunded the amount you paid for it.
  • Refunds go back to the original payment method through Stripe. Your bank sets how long they take to appear.
  • Contact Support if a payment or refund looks wrong.

How to behave

Be respectful to the field operator, the guide, the director and other participants. You agree not to:

  • harass, threaten, discriminate against or exploit anyone, or ask the field operator to do something unsafe, unlawful or intrusive;
  • record, capture, copy or redistribute a session, or collect images or voices of people in it, without our written permission;
  • try to identify, locate or contact the field operator, guide or other participants outside the service;
  • use the microphone to disrupt a session, or work around a hold, mute or removal;
  • upload unlawful content or malware, or interfere with, probe or overload the service;
  • use the service for any commercial purpose without our agreement.

We may warn you, remove you from a session, suspend or close your account, and cancel a booking if you breach these terms or put anyone at risk. Where we cancel because of your breach, we may not refund the booking.

Your content

You keep ownership of what you submit (photo, requests, reviews, support messages). You give BeThere a worldwide, non-exclusive licence to host and use it to run and improve the service. A review is published only if you choose to publish it and our team approves it, and it appears without your name.

BeThere, its software, branding and the session content are ours or our licensors'. You get a personal, non-transferable right to use the app for its intended purpose.

Privacy

How we handle personal data is explained in the Privacy Policy. You can ask to delete your account as described on the account deletion page.

Availability and changes

Sessions depend on people, venues, weather and your connection. We may reschedule or cancel a session, change features, or suspend the service for maintenance. We aim to tell you promptly, and refund as set out above when we cancel.

Disclaimers and liability

The service is provided "as is" and "as available", to the extent the law allows. We do not guarantee uninterrupted or error-free operation. To the extent the law allows, BeThere is not liable for indirect or consequential loss, and our total liability for a claim relating to a booking is limited to the amount you paid for that booking. Nothing in these terms limits liability that cannot be limited by law, including for death, personal injury or fraud, or removes your rights as a consumer.

Ending your use

You can stop using BeThere and request deletion of your account at any time (see the account deletion page). Sections that by nature should continue after that, such as licences, liability and payments owed, continue.

Changes to these terms

We may update these terms. The date at the top shows the latest version. For material changes we will notify you in the app or by e-mail before they apply; using the service afterwards means you accept them.
